Every bankruptcy case has at least one hearing in which we meet with the bankruptcy trustee. The trustee will ask questions to verify the accuracy of your bankruptcy petition and schedules and to ask
any follow-up questions that may be necessary to gain a complete understanding of your case.

This is referred to as the “Meeting of Creditors” because creditors can also appear and ask questions, although they seldom do. A typical hearing lasts about five minutes. Bankruptcy is in federal court, so hearings are not held in every county as in state court proceedings.

“Meeting of Creditors” hearings for all counties in the Rochester area are held in Rochester. This hearing is scheduled for approximately one month after we file the bankruptcy petition with the court. Attorney Gregory Wald will attend the hearing with you.

Changes in Bankruptcy Law

The new law allows most people to file for bankruptcy protection. Bankruptcy is still available for the general public and debts can still be eliminated.

There are now some additional steps to take to file a bankruptcy. Before you file for bankruptcy protection, you must complete a credit counseling session with a credit counseling agency that has been approved by the court. The credit counseling session can be done over the phone or internet and will take about a half hour to an hour. There will normally be a small fee.

After we file your bankruptcy, you must complete a financial management course with a court-approved agency. There will be a small fee for this course, which can also be taken over the internet or by filling out a workbook.
